1. Definitions

In these terms and conditions, the following definitions apply:

  • "We / Us / Our" — Khao Legal, a family law practice registered in Bangkok, Thailand.
  • "You / User" — any person accessing this website or engaging our legal services.
  • "Services" — the family legal services offered by Khao Legal, including domestic protection order applications, stepparent legal recognition counsel, and complex family estate coordination.
  • "Website" — the website accessible at khaolega.live.
  • "Agreement" — the legally binding engagement established between Khao Legal and a client upon acceptance of a formal retainer or engagement letter.
  • "Content" — all text, materials, and information published on this website.

2. Acceptance of Terms

By accessing this website or submitting an enquiry, you confirm that you have read, understood, and agree to these terms. If you do not agree, please do not use this website or engage our services.

Our services are available to persons aged 18 and over who have the legal capacity to enter into binding agreements under Thai law. By submitting an enquiry or engaging our services, you confirm that you meet these requirements.

These terms apply to general website use. The legal relationship between Khao Legal and a client in an active matter is governed by a separate engagement letter, which takes precedence over these terms in the event of any conflict.

3. Service Description

Khao Legal provides family law services in Thailand. Our three principal service areas are:

  • Domestic Protection Order Application — preparation, filing, and representation in protection order proceedings under Thai family law.
  • Stepparent Legal Recognition Counsel — advisory and procedural assistance for stepparents seeking formal legal recognition of their relationship with a stepchild.
  • Complex Family Estate Coordination — review, structuring, and documentation of family property and business arrangements spanning multiple generations.

Services are delivered from our office in Bangkok and are subject to the procedural requirements and timelines of Thai courts and administrative authorities. We make no representation that any particular outcome will be achieved.

This website is an informational resource. No solicitor-client relationship is created by accessing this site or submitting an enquiry. A formal engagement commences only upon execution of a written retainer agreement.

4. User Responsibilities

When using this website, you agree to:

  • Provide accurate and complete information when submitting enquiries or engaging our services.
  • Not use this website for any unlawful purpose or in a manner that could harm others.
  • Not attempt to interfere with the operation or security of this website.
  • Not reproduce, distribute, or commercially exploit any content from this site without our written consent.
  • Notify us promptly if any information you have provided changes or becomes inaccurate.

In the context of an active engagement, clients are also responsible for disclosing all information that is relevant to their matter, responding to requests for documentation in a timely manner, and notifying us of any developments in their situation.

5. Intellectual Property

All content on this website — including text, layout, design, and descriptive material — is the property of Khao Legal or its licensors and is protected under applicable intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to access and view the content of this website for personal, non-commercial purposes. This licence does not permit you to reproduce, modify, distribute, or create derivative works from any content without our prior written consent.

Documents prepared by Khao Legal in the course of a client engagement remain the intellectual property of Khao Legal until all fees have been paid in full, at which point the client receives a licence to use those documents for the purpose for which they were prepared.

6. Payment Terms

Our service fees are as follows:

  • Domestic Protection Order Application: ฿9,500
  • Stepparent Legal Recognition Counsel: ฿14,200
  • Complex Family Estate Coordination: ฿34,800

Fees are quoted in Thai Baht (฿) and are subject to confirmation in the engagement letter for each matter. Payment schedules, deposit requirements, and methods of payment will be specified in the engagement letter. All fees are exclusive of any court filing fees, official charges, or disbursements, which will be itemised separately.

Where a matter does not proceed or is terminated early, fees will be assessed in accordance with the terms of the relevant engagement letter. We do not offer refunds for work already completed.

7. Service-Specific Terms

The following additional terms apply to our legal services:

  • Scope of services — the scope of each engagement is defined in the engagement letter. Work outside that scope requires a separate instruction and may involve additional fees.
  • Timelines — estimated timelines are indicative only. Matters involving court proceedings or the cooperation of third parties are subject to factors outside our control.
  • Client duties — clients are required to provide complete and accurate instructions. Knowingly providing false or misleading information to a court or authority is a serious matter and may affect our ability to continue acting.
  • Confidentiality — communications between Khao Legal and its clients are confidential, subject to applicable professional obligations and any overriding legal requirements.
  • Professional obligations — our advisers are subject to the professional standards of the Lawyers Council of Thailand. Nothing in these terms limits those obligations.

8. Disclaimers

The content of this website is provided for general information purposes only. It does not constitute legal advice and should not be relied upon as such. Legal matters are fact-specific and the information on this site may not be current or applicable to your situation.

We make reasonable efforts to keep the information on this website accurate, but we do not warrant that all information is complete, current, or free from error. We expressly disclaim any liability arising from reliance on the information published here.

Outcomes in legal proceedings are not predictable and depend on many factors, including the decisions of courts and administrative authorities that are independent of us. We make no representation about the likely outcome of any matter.

9. Limitation of Liability

To the extent permitted under Thai law, Khao Legal's liability for any claim arising in connection with services provided is limited to the fees paid for the specific matter to which the claim relates.

We are not liable for indirect, incidental, consequential, or special damages, including loss of opportunity, loss of income, or damage to reputation, even if we were advised of the possibility of such losses.

Nothing in these terms limits liability for fraud, wilful misconduct, or any matter that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Khao Legal and its advisers against any claims, losses, costs, or liabilities (including reasonable legal costs) arising from your breach of these terms, your use of this website, or any information you have provided to us that is false, misleading, or incomplete.

11. Termination

Either party may terminate an engagement by providing written notice to the other, subject to the terms of the engagement letter for that matter.

We reserve the right to terminate or suspend access to this website at any time without notice, including in response to misuse.

Sections of these terms that by their nature survive termination — including intellectual property, disclaimers, and limitation of liability — remain in effect after any termination.

12. Dispute Resolution

These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from the use of this website or the provision of our services will be subject to the exclusive jurisdiction of the courts of Thailand.

Before commencing formal proceedings, we encourage parties to first seek to resolve any dispute through direct discussion. Where informal resolution is not possible, disputes may be referred to mediation under the rules of the Thai Arbitration Institute, if both parties agree.

13. General Provisions

  • Entire agreement — these terms, together with any engagement letter, constitute the entire agreement between you and Khao Legal in respect of its subject matter.
  • Severability — if any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in effect.
  • Waiver — our failure to enforce any provision of these terms does not constitute a waiver of our right to do so in the future.
  • Assignment — you may not assign your rights or obligations under these terms without our written consent. We may assign our rights in connection with a reorganisation of our practice.
  • Notices — formal notices should be sent in writing to our office address or to [email protected].

14. Changes to These Terms

We may update these terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of this website after any update constitutes acceptance of the revised terms.

We recommend reviewing these terms periodically. Changes will not affect matters already subject to a signed engagement letter unless separately agreed in writing.
